Summary

This is a technical consultation which seeks comments on the draft legal provisions intended to give effect to the policy conclusions published on 30 March 2026 in the Government response to the 2024 consultation. 

The Alternative Transitional Registration Model (ATRm) is intended to provide a more proportionate framework for registering transitional substances while maintaining a high level of protection for human health and the environment. It reduces the hazard information that must routinely be submitted upfront to the Health and Safety Executive, while enabling the regulator to request further information where necessary to assess potential hazards and risks. 

The ATRm will be delivered by way of a Statutory Instrument (SI) which amends UK REACH. The proposals are presented in this consultation as amendments to the legal text of UK REACH, to show how the regulation will look if the proposed amendment SI becomes law. This document is known as a Keeling Schedule. It is hoped that presenting the proposals as a Keeling Schedule will make it easier for stakeholders to understand and comment on their effect.

This is a public consultation, and we welcome all views, particularly those from chemical businesses, downstream users of chemicals and NGOs. The questions are presented in a way to accommodate both a general audience and stakeholders with specialist knowledge on the regulation of chemicals.

We are seeking comments on whether the drafting demonstrated in the Keeling Schedule presented with this consultation clearly and accurately gives legal effect to the policy intentions set out in that response and this consultation, and whether any potential drafting issue, omission, ambiguity or unintended consequence appears to be present in the drafting which needs be addressed before the SI is finalised.

In particular, we welcome evidence of any potential drafting issue, omission, ambiguity, inconsistency, procedural gaps or unintended consequence that should be addressed before the legislation is finalised. Where possible, respondents are invited to explain the concern and suggest drafting changes.
